@nemesis oh you're fine, the main takeaway is just that the SCOTUS does not, cannot craft laws or policy as such, their role is to determine whether or not a law or policy is constitutional, or how the law should be interpreted in cases where there is ambiguity or disagreement

The main obstacle is having a case go to the court, so, there would have to a state enforcing an old law or passing a new law that restricts certain forms of sex, and so SCOTUS wouldn't have to implement the ban so much as strike down previous rulings declaring it's a 'state's rights issue' this is the same way that would 'legalize' bans on inter-racial mairage... in either case many states still have these laws on the books, they're just not enforced and so they'd be 'reactivated' in the case of such rulings.
was thinking about this the other day: how bird song is not considered real language or communication because it's repetitive, but there's obviously a reason birds are making all that noise, maybe there is some syntax in the subtle variations of those repetitive patterns we don't pick up on that communicate more complex information
