Prediction time; attitudes toward sex throughout history
@nemesisThe main obstacle is having a case go to the court, so, there would have to a state enforcing an old law or passing a new law that restricts certain forms of sex, and so SCOTUS wouldn't have to implement the ban so much as strike down previous rulings declaring it's a 'state's rights issue' this is the same way that would 'legalize' bans on inter-racial mairage... in either case many states still have these laws on the books, they're just not enforced and so they'd be 'reactivated' in the case of such rulings.
